Court Admits More Evidence Against Naira Marley on Credit Card Fraud

The Economic and Financial Crimes Commission (EFCC) has presented more pieces of evidence against Azeez Fashola, famously known as Naira Marley, in an ongoing credit card fraud case.

The trial of Fashola continued before Justice I. Nicholas Oweibo of the Federal High Court sitting in Ikoyi, Lagos, on Friday. Dein Whyte, a prosecution witness and operative of the EFCC, produced further evidence against Fashola, who is standing trial on an 11-count charge bordering on credit card fraud brought against him by the EFCC.

Olalekan Ojo, SAN, the defence counsel, objected to the witness’s opinion on the forensic evidence linking Fashola to credit card fraud on June 9. Ojo argued that an investigator could not make pronouncements on the defendant’s culpability.

Justice Oweibo delivered a short ruling on July 15, in which he dismissed Ojo’s objection.

“It is the duty of the law enforcement agency or police charging a person to court to investigate if the defendant committed the crime or not. The investigator must be able to link the defendant to the commission of the crime,” he ruled.

“The prosecutor must have made up his mind as to the involvement of the defendant before bringing the case to court. I do not agree that the prosecution has declared the defendant guilty.”

The court admitted more evidence presented by the prosecution on Friday and adjourned the case till September 26.
